Paternity proceedings are used to establish the identity of a child’s biological father in cases where the identity is not already established under Arkansas law. Tripcony May represents both mothers and fathers in paternity proceedings. 

Mother’s Rights

While a woman is pregnant, the father has no rights. She does not need his permission to get an abortion, nor does she need to tell him about the procedure. However, if she chooses to carry the child to term, the father will have responsibilities under Arkansas law. He may be required to pay child support and/or cover some of the cost of the pregnancy and birth. He can also seek visitation or custody. 


Father’s Rights 

A father whose identity has been established by law has the right to seek custody and visitation rights. He may also be required to pay child support. It is important to note that none of these rights or responsibilities will exist until paternity has been established. 


Legitimization and Paternity

If a child’s mother and father aren’t married at the time of the child’s birth, you need a court order or an Affidavit Acknowledging Paternity to establish the father’s legal identity. If the father does not willingly admit paternity, a paternity test can be scheduled.
