About Surrogacy in Arkansas

Arkansas allows both traditional and gestational surrogacy. In traditional surrogacy, the surrogate carrier uses her own egg, which is artificially inseminated with donor sperm or the intended father’s sperm. In gestational surrogacy, the surrogate carrier carries an embryo that has been transferred to her uterus and is not made from her own egg. This embryo may be the product of the intended parents, a single parent with donated sperm or egg, or donations of both sperm and egg. 


The legal portion of this process comes in two phases:


  1. Contract - During this phase the intended parents and the surrogate carrier draft and negotiate an appropriate contract. Once this contract is complete, attempts to begin a pregnancy will begin. 
  2. Pre-Birth Order - If the pregnancy is successful and makes it to 20 weeks, the intended parents will begin the Pre-Birth Order process. This order makes the legal status of all parties clear to the midwife, doctor, birthing center, and/or hospital.
